Cyprus International Trusts (CITs) provide sophisticated wealth management, asset protection, and succession planning tools under the Cyprus International Trusts Law of 2012 (as amended). CITs benefit from perpetual duration, asset protection from foreign judgments, tax neutrality on foreign income and gains, confidentiality, and access to Cyprus's treaty network.
The Cyprus International Trust framework
The Cyprus International Trusts Law (69(I)/1992), significantly amended in 2012 and subsequent years, established one of the most flexible trust regimes globally. A CIT can be created by a settlor who is not a Cyprus resident in the year preceding creation. Beneficiaries can be Cyprus residents or non-residents. At least one trustee must be Cyprus resident during the trust's existence.
CITs may hold worldwide assets (real estate, securities, business interests, intellectual property, cash, art) and can be structured for various purposes including family wealth preservation, succession planning, employee benefit schemes, philanthropic activities, and asset protection.
Key advantages
Perpetual duration: unlike common law trusts limited to 21 years, CITs can continue indefinitely, ideal for multi-generational wealth structures. Asset protection: assets settled into a CIT enjoy protection against subsequent claims by settlor's creditors, subject to a 2-year fraud lookback period. Tax neutrality: CITs are not taxed in Cyprus on foreign-source income or gains where beneficiaries are non-Cyprus residents. Confidentiality: trust deed and beneficiary information are not publicly filed, though UBO disclosure to competent authorities applies. Flexibility: settlor can reserve powers (investment direction, beneficiary appointment) without invalidating the trust.
Setting up a CIT
Establishing a CIT involves selection of trustee (Cyprus-licensed trust company), drafting the trust deed specifying beneficiaries and terms, transferring assets to trust ownership, and ongoing administration by the trustee (typically annual accounts, tax filings for Cyprus-source income, distribution management). Typical setup costs range €3,000-€10,000 for standard CIT structures, higher for complex arrangements.
Annual trustee and administration fees depend on trust complexity and asset value, typically €5,000-€20,000+ annually for actively managed CITs.
CITs and international tax planning
CITs are commonly integrated with Cyprus holding companies, foundations, and other structures to achieve tax-efficient wealth structuring. Post-BEPS, the emphasis is on genuine substance — real Cyprus trustee activity, documented trustee decision-making, and commercial rationale beyond tax optimisation. CITs cannot serve as passive tax-avoidance vehicles under modern rules.

Συχνές ερωτήσεις
Who can settle a Cyprus International Trust?
The settlor must not have been Cyprus tax-resident in the year preceding trust creation. This ensures the CIT designation for non-Cyprus wealth. Cyprus tax-resident settlors can use standard Cyprus law trusts (Companies Law and Trust Law framework) but do not benefit from all CIT provisions.
Are Cyprus trusts confidential?
CIT deeds and beneficiary information are not publicly filed at the Registrar of Companies. However, ultimate beneficial owners must be disclosed to the Beneficial Ownership Registry (accessible to competent authorities and, with legitimate interest, to certain third parties under EU AML rules). Fully anonymous trusts are not compatible with modern AML compliance.
Can I be a beneficiary of my own Cyprus trust?
Yes. The settlor can be included as a beneficiary of the CIT they establish, though this may have tax residency implications in the settlor's home jurisdiction. Discretionary trust structures with settlor as one of several beneficiaries are common.
What is the asset protection reach of a CIT?
Assets settled into a CIT are protected against subsequent claims of the settlor's creditors, subject to a 2-year lookback period during which transfers can be challenged as fraudulent. After 2 years, the trust assets are largely insulated from settlor's personal creditors, though public policy exceptions apply for matrimonial claims and specific insolvency scenarios.
How are Cyprus trusts taxed?
CITs are not taxed on foreign-source income where all beneficiaries are non-Cyprus residents. Where any beneficiary is Cyprus resident, that beneficiary's share of income may be attributed and taxed at the beneficiary's personal rates. Cyprus-source income (rental, Cyprus dividends, Cyprus real estate gains) is subject to normal Cyprus tax rules regardless of beneficiary residency.
Do I need a Cyprus lawyer to set up a CIT?
While not strictly required, a Cyprus lawyer's involvement is essential for proper trust deed drafting and to ensure compliance with CIT Law requirements. Most CIT structures involve both lawyer (trust deed) and licensed trustee (ongoing administration). Some corporate services providers offer combined services.
